Subject :  Transfer and Posting in the Non-Gazetted category staff of Postal Civil Wing
Sir,
          With due respect, we would like to submit the following points for your kind re-consideration on the above subject.
          As per the discussion had under the chairperson ship of Major General Smt.Meena Datta, Additional Director General (Co-ordination) on 28.03.2017, the implementation of the orders issued on 02.02.2017 and 06.02.2017 have been extended upto 31.05.2017 as per the minutes issued (even though we have not received the minutes officially) but conveyed to your office to all Superintending Engineers to call for the options from the employees and sought compliance report by 15.06.2017.

          In this connection we would like to submit following points for your consideration:-

1.           Before deciding the transfer and posting of the staff as per the distribution now issued a uniform transfer posting policy for the ministerial staff is required to be finalised as at present there is no policy in this regard but the Superintending Engineers have issued circulars to all staff to submit options for transfer and posting. Without the uniform policy no staff is aware of his tenure in a station hence there are all possibilities of favouritism, pick and choose system by the concerned Superintending Engineers.  As on date in accordance with the existing instructions of the Government of India there should be a transfer and posting committee and the policy of transfer and posting policy should be supplied to them along with the options submitted by the officials and request of transfer on their personal grounds while the meeting is held and justified minutes have to be issued.  But now the practice is being followed in Civil Wing that prior to referring the case to T&P   Committee   in   the  Circle,  the   prior decisions
are conveyed by the Superintending Engineers to the Committee members and the minutes are issued accordingly hence there are number of litigations are arising after the issue of transfer orders.

2.           We are receiving enquiries from our rank and files posted at present in remote localities like Andaman & Nicobar Islands, North Eastern States stating that they are unable to submit the options because of the reason of unawareness of stations available for them under their circle itself. Most of the staff are not aware of the jurisdiction of the Postal Civil Circles in which they are working.  The incentives/benefits of transfers have also not been furnished by the Superintending Engineers as decided in the meeting. In the light of the above the date for submission of the options may be revised and target date of implementation of the orders may kindly be extended to a reasonable time after submission of the options.

In view of the above, it is requested that the Superintending Engineers may be directed to issue the sanctioned posts and stations available for options to the staff along with the stations and the tenure of service and accordingly the time.  Further, the uniform transfer and posting policy may kindly be finalised prior to holding the transfer and posting committee meeting in consultation with the recognised unions.

Sir,
          We are one of the departmental recognised union vide Directorate letter No.17.09.2015-SR dated 14.08.2015 in the Civil Wing.
          We regret to inform you that the Civil Circle Heads are not conducting regular meetings with the Union Representative to sort out the issues as per the rules and even the Chief Engineer level meeting is also conducted as per their convenience without abiding the rules which is denial of trade union facilities to the recognised union. 
          We have been requesting the Chief Engineer time and again to accord trade union facilities in the prescribed time in accordance with rules prevailing as on date. Accordingly in the last meeting held on 01.08.2016 with Chief Engineer and as per minutes issued vide No.10-9(1)/CEND/Union Meeting/2013-14/824 dated 04.08.2016 it has been decided that the Superintending Engineer, Civil)/Elect. Shall hold meeting with the union representatives as per rule.  But it is regretted that except Superintending Engineer (Civil) at Bangalore and Calcutta no other Civil/Electrical Superintending Engineers have conducted any bi-monthly meeting till date even after the direction from Chief Engineer. .
          It is, therefore requested that necessary instructions may kindly be issued to all Chief Postmaster Generals and Chief Engineer to include our representative in four monthly meeting and Superintending Engineer to conduct the bi-monthly meeting with our representatives as per the existing rules for which we shall be grateful so that the grievances of our rank and file through discussions and mutual understandings.   An immediate action is solicited.

Subject :  Non-imparting proper induction training to Non-gazetted staff of Civil Wing – regarding.

Respected sir,

                   With great respect and expectation of favorable decision from your good self we would like to submit the following grievance in respect of our members of Union.

                   Nowadays the non-gazetted staff viz. Junior Engineers (Civil and Electrical) and ministerial clerical staff are being recruited through Staff Selection Commission on the basis of the competitive examination held on All India Basis and nominated for appointment in our Department as such mostly they are entering into service direct from their studies.

                   While issuing the appointment orders to these candidates the Civil Wing administration inserts a condition that they should complete induction training for successful completion of probation period of two years in both the case of Junior Engineers and clerical staff.  In the case of Junior Engineers they have also to qualify the simple accounts examination for earning second increment and probation clearance as well for which these induction training is inevitable.  Due non-conducting the training the Junior Engineers have faced lot of difficulties for preparation of the examination conducted by CPWD and most of them qualifies after two to three attempts.  

In this connection we would like to state that since the newly appointments taken place since 2010 in both the cases of Junior Engineers and clerical staff no training have  been  imparted  to them by the  Department due to which the probation clearance have been delayed till last quarter of 2016 that too by issuing relaxation to the Junior Engineers who have been appointed prior to 31.03.2014 on the basis of series of demand from Our Union vide Chief Engineer(Civil)’s letter No.4-15/2013-CWP/69 dated 20.05.2016 even then in some Civil Circles it is still pending for issue of clearance of probation of Junior Engineers.     Now the Directorate vide letter No.4-15/2013-CWP/163 dated 27.09.2016 the Superintending Engineers (Civil/Elect.) have been asked them to impart in-house training at their level.  But the Superintending Engineers have issued directions to the Executive Engineers.  They in turn asked the Assistant Engineers  to conduct the same which never going to happen due to their own works in hands.  As you are aware, the purposeful training can be imparted only in an atmosphere of institutes by experts in the subject as faculties without which quality discharge of their performance in the line of procedural and codal can be expected and they should not be humiliated on this account.
 
  Due to non-imparting of training at the induction stage itself as is done in the other Postal Cadres the Junior Engineers are ignorant on the procedural and technical requirements of the Central Government works hence they are compelled to follow the theoretical study they had in the college as such they have to compromise with the contractor’s line of execution of works.  Everybody is aware that the contractors are for their business earning and not for making benefits to the departments or nation. The senior engineers existing in the Departments is the habit of assigning the field work from the next day of joining the department by these new entrants without any consideration of their inexperience of field work but whenever any fault is found by any authority competent to do so, these senior officers shifts their responsibility to shoulders of these innocent Junior Engineers and their service career becomes a nightmare to them.  Due to which they could not find out any better assignment in any Government service due to their unsatisfactory service records like APAR or disciplinary proceedings etc.  This is only because of the inaction of the Civil Wing Administration by not finding any way out for imparting induction training.

          In the case of who have been appointed on transfer basis twenty years back and the new recruits have also lack training in the field of Civil Wing works.  The incumbents as and when joined the Department have been assigned with directly to work without any knowledge and neither a refreshment course/training to the transfer appointees and no induction training have been imparted till date any training.

          When the Government of India decided that only the tendering should be made through e-procure the Department imparted training to officers in the grade of Superintending Engineers and Executive Engineers.  But they never attempts or in other way we can say that definitely they could not practically able to upload the tenders in the e-procurement website due to their own responsibilities of discharging their field duties.  Even the available Draftsman even though very few in the Department who are actually responsible for preparation of tender documents have not been imparted training in e-procure or other civil wing functionalities.  Now the practice is being followed that either the stenographer or the available clerical staff is doing all these works.

          The clerical staffs are not at all responsible for preparation of tender documents and uploading the same in the e-procurement website are being compelled to do so and whenever any mistake is happened in these activities the responsibility is being fixed on them which is highly objectionable.

          As your good self knows that we have our own training institutes functioning at various places in the country and imparting training to the Civil Wing new recruits can be imparted training within our Department and the budgetary provisions.  The experienced faculties in the field can be found out from our own Departmental Engineers as well as from other Engineering Department like CPWD, MES and AIR.  The administration side can be imparted by our own faculties available with these institutes as is done in the case of Postal Assistants and Sorting Assistants.

          In view of the above, we request you to kindly see the matter and we expect a positive approach to the issue in the interest of saving the young generation who are entering the service in the Postal Civil Wing.

Respected sir,

            With great respect and expectation from your good self on humanitarian basis to Group-C and MTS staff of the Postal Civil Wing for which the next generation staff members will ever remember you and the new recruits will find the service as attractive.

            The present scenario of the Civil Wing in respect of Group-C staff including MTS are pathetic due to the insertion the cadre in the sensitive posts by the Central Vigilance Commission latest instructions hence everybody now in service are facing lot of difficulties in service as the lowest paid employees of the employees have to change of place of posting to various outstations alike Postal Department’s other establishments.  As your good self is well aware, that as matter of policy Postal and RMS Operative Staffs is not liable to be transferred from one Division to another except on Rule-38 transfer on their request and in case of punishment or present cadre review promotion.

            The Postal Civil Wing is following all the staff pattern and nature of works which are being followed in the Central Public Works Department and Military Engineering Service, Doordarshan and AIR etc.etc.  Even though the staff pattern was following prior to bifurcation of P&T Department till 31.03.1997 thereafter only 50% of the staff strength was filled up on transfer   basis   from    various   ministries      and departments of Government of India up to 31.03.1997.  All the Postal and Telecom ministerial employees working then was relieved in full.  The Postal Civil Wing Administration have not taken up any initiative for appointment of the balance fifty percent vacancies due to which out of Works Clerk Grade-II- 339 posts Works Clerk Grade-I-117 transferred from DOT were reduced to Works Clerk Grade-I – 02 and Works Clerk Grade-II -178 were abolished vide office order No.3-7/2009-CEND/1489 dated 30.08.2010 i.e. more than 50% of the available posts as on 31.03.2010.  This is not because of the policy of 10% reduction on year to year vacancy basis by the Government but because of the inaction of the Civil Wing Administration since 01.04.1997.   However, the existing staffs by putting up their maximum efficiency the civil wing works has been running smoothly in one or other way up to the satisfaction of the Circle Heads.    

            Further to the existing acute shortage of staff considering other engineering departments of the Government of India where the turnover of the Division Offices is more or less equal to our offices also.  As per the information received under RTI by the undersigned the average turnover of each Civil Division is more than 7.00 crores and Electrical Divisions 8.00 crores.  For incurring the expenditure the Division Office has dealt with average 127 tenders in Civil Division and 141 tenders in Electrical Divisions.  For maintaining all the formalities of tendering, entering agreements and up to payment to the bills to contractors excluding the administrative and establishment works and dealing with Arbitration and Court Cases, RTI cases every Division is facing difficulties with the existing staff.  A snake bite happened to a person in addition to a thunder stroke, now the Department has reduced 25 posts of Works Clerk Grade-II vide order No.1-3/2016-CWP/316 dated 03.11.2016 may be because of an apex court Judgement or so accordingly the number of post of Works Clerk Grade-II has been again reduced to 136 in place of 161. Immediately on receipt of the order from the Directorate, the Civil Wing Administration has issued an office order No.1-3/2-16-CWP/255 dated 02.02.2017.  In this connection we would like to state in the operative side of Postal Department, large numbers of posts have been abolished but the Directorate has redistributed the posts to Circle Heads for issue of orders of transfer and postings wherever necessary.  But in the case of Civil Wing Administration the Chief Engineer himself has decided the distribution of posts and adamant to transfer the lower paid employees of Works Clerk Grade-II to remote places of the Country whereas the same administration could not fill up the vacancies of MTS 642 sanctioned posts for more than two years. 

            Further to say that Civil Wing Administration is very much concerned about the functioning of the office of Assistant Engineers where there is at the most four to five tenders are being processed in a year whereas the Division Offices are processing more than 6.00/8.00 crores work tenders and bills.  It is insisted by the Chief Engineers officers to Superintending Engineers to transfer the clerical posts to Assistant Engineers office from Division Office as per the new distribution issued on 02.02.2017.  As per the new distribution only three clerks and one Assistant (which was a supervisory post of Head Clerk earlier) is left out to Division Offices in some cases only two clerks only available.  This will jeopardise the total functioning of the Division Offices and the Union will not be held responsible for any lapse in the functioning of Division Office and also state that we will not permit to harass or fixing responsibility on any staff member for the lapses in functioning.  No time bound booking of funds should be insisted on the staff and denial of their legitimate right of availing admissible leave etc.  Incidentally I would like to state that in some Civil Divisions there are staff working on deputation basis from the operative side or circle office.  Now on abolition of various posts in the Postal Operative Side and Cadre Review approval there are all possibility to withdraw these staff from our offices due to shortage of staff in operative side which is important for the Department than the Civil Wing affairs. 

          It is further stated on bifurcation of the Department of P&T, the Postal Civil wing was having more than 398 posts of Junior Engineers.  As in the case of clerical staff, no appointment was made by the Department of Posts till 2009 to the posts of Junior Engineers and 50% posts were occupied either by the staff of BSNL or on deputation from various Departments like AIR.  Hence 198 posts and 9 posts were abolished vide No.3-45/2001-CWP(Part)/ dated 05.06.2009 and No.1-3/2016-CWP/178 dated 17.10.2016 respectively accordingly the Chief Engineer distributed 195 posts vide their order No.1-3/2016-CWP/184 dated 25.10.2016 leaving two Junior Engineers in a Sub-Division. 

            The Jurisdiction of one Sub-Division comprises of minimum 300 square kilometres and having at least four Postal Divisions.  These two Junior Engineers who are the actual executors of the works at site are responsible for the preparation of estimates, co-ordination with the contractor, ensuring quality of work, measurement at site, preparation of bills and also assisting Assistant Engineers/Executive Engineers for fixing fair rent assessment of the rented buildings.  Whenever a small lapse on the part of the Junior Engineers are viewed seriously by the superiors and they are very much interested in issuing memos and framing charges against them to get rid of their responsibility for the lapses happened in the works.  For getting efficient discharge of duties and quality of work the jurisdiction of the each Junior Engineers should be placed for each Postal Divisions for which creation of posts is required so that it can be at par with CPWD/MES/AIR. 

            In some Circles, the Chief Postmaster General has accorded sanctions for official mobile phone connections to Junior Engineers but in some circles it is not permitted by Circle Offices.  There are no uniformity in providing facilities to the staff members of Civil Wing.

            We would like to state an example of a case of harassment to a female Junior Engineer who has directly came from college to service and without imparting any training by the Department she has received memos from the second week of her service and even on her marriage date a memo was issued to her by the Assistant Engineer.  Now on closure of the financial year the number of letters issued to her numbered to more than 250 that too back dated and without acknowledgement.  The superior officers like Assistant Engineer and Executive Engineer is threatening with degradation of APAR grading so that her extension probation period and denial of other benefits like leave etc.  The intention of these officers is not for extracting the work but for the reason best known to them.  When she submitted the appeal to the Superintending Engineer for re-consideration with facts and figures, she is receiving more threats which is leading to threat of her peaceful family life.  Some Executive Engineers are in the habit of sending SMS at odd hours for attending faraway places of work side at early morning knowingly that they cannot attend that place at the time and for recording and issuing memo purpose.

            Whenever, a case of administrative nature case for approval/sanction send to office of Circle Offices/Headquarter office in the case of non-gazetted staff the same is not disposed off timely and takes months together.  If we take up the case with those offices informally the answer received by us is that there is shortage of staff hence delay.  But it is regretted to say that whenever a case of senior officers is referred the same is returned within no time.  We could not understand how it is possible for senior officers but denied to non-gazetted staff.  To prove this we furnish an example that an LTC case of a disabled person who used his own car for the purpose stands referred to Civil Circle Office for getting the approval of Head of the Department which is pending for more than nine months.  But if a LTC/TA bill of any senior officers is received in any office the payment is made within no time.

            One Junior Engineer (Civil) was transferred from other state to his home state as per his option for transfer.  Immediately on joining the place of his actual posting he was provided with an additional charge in other Sub-Division which is away for more than 750 kilometres without any extra remuneration.  Now the incumbent is neither able to concentrate in his original posting nor in the additional charge. Now the person is spending more time in transit than in work.   In the case of the Junior Engineers posted in North Eastern Region the incumbent has travel in hilly areas for more than one day to reach the work site from his headquarters so as human habit they try to avoid the restless travelling which definitely may affect the quality of work also.  If the posting is made in the Postal Divisional Offices it will be convenient to them to proper supervision of work and can ensure the quality to the extent of expenditure made from the Govt. Exchequer.

            It is further submitted that the nodal ministry has issued orders for cadre review and cadre restructuring on the basis of the accepted VIth Pay Commission Report which came into force from 01.01.2006.  But it is regretted to say that after a prolonged correspondences by us to administration the same has not yet done till today i.e. even after VIIth Pay Commission which would have benefited us. 

            We are thankful for granting us positive hearing on 28.03.2017 under the chairperson ship of Major General  Meena Datta, Additional Director General(Co-ordination).  The minutes of the meeting is not yet issued but the Chief Engineer and Superintending Engineers are very keen and adamant to issue the transfer orders as pick and choose basis in the absence of uniform transfer and posting policy and in some cases it has already been issued which is against the decision of the meeting.

            In view of the above, we request that the following direction may kindly be conveyed to Civil Wing Administration for which we shall be grateful.

1.       To hold the transfers and postings in the grade of ministerial staff till finalisation of uniform transfer posting policy for entire Civil Wing as there no policy is available as on date.  The policy has to be finalised in consultation with the recognised union representative otherwise we will be compelled to approach Court of Law for getting justice
2.     Appointment of available posts as on date
3.     Time bound cadre review of ministerial cadre and according the benefits from 01.01.2006
4.     Creation of posts as per the proposals submitted by us on 28.03.2017
5.     Creation of post of one Junior Engineer (Civil) in each Postal Divisional Headquarters and one Junior Engineer (Elect) for two Postal Divisional offices.

FLEXI RATE OF TICKETS ON RAJADHANI/SHATABDI/DURONTO MADE ELIGIBLE FOR LTC



THE ITEMS DISCUSSED WITH THE DEPARTMENT ON 28.03.2017 ON ISSUE OF STRIKE NOTICE FROM 29.03.2017

1.           WITHDRAWAL OF ORDER NO.F.NO.1-3/2016-WP/255 DATED 02.02.2017& 06.02.2017:-

On bifurcation of the Department of Posts and Department of Telecom the posts of ministerial cadre was transferred from DOT as follows:-

Works Clerk Grade-II                 -         339
Works Clerk Grade-I                 -         117
Head Clerk                               -           27
Office Superintendent              -                  9

Up to 31.03.1997 these posts were occupying by the Telecom Assistants and Postal Assistants. The Department of Posts have commenced the direct appointment in the cadres of Civil Wing since 2010 only.  Till 1997 the filling up of the posts were done by either on deputation or inter-departmental transfers up to 50% of total sanctioned strength.  Since 1997 to 2009 there was no appointment in any cadre by direct recruitment due to non-finalization of Recruitment Rules. Without considering the lapses in recruitment process by the Department all the vacant posts stands abolished vide order No.3-7/2009-CEND/1489 dated 30.08.2010 as per the Government policy prevailing at that time without conducting any work study or actual requirement of the posts.  Due this abolition each and every office was facing acute shortage of staff and heavy work load on the meager available staff.
Now the Department have issued an order No.F-1-3/2016-CWP/255 dated 02.02.2017 vide which it has abolished further 25 posts of Works Clerk Grade-II and distributed the staff amongst the offices without any consideration of work load and in a non-manageable manner to run these offices due to over load on the existing staff.  Even if the staff puts their 24x7 service the workload cannot be met out.  The curtailment of staff strength affected very badly the promotional aspects of the existing staff also and the female staff members are facing lot of difficulties to avail the Child Care Leave/Maternity Leave as the leave sanctioning authorities are rejecting the applications stating the reason of shortage of staff and workload.

 As per the information obtained under RTI by us, each and every office of Executive Engineers have on an average basis executed works of 8.00 crores on every financial years during the last five years by following 121 tender formalities and agreements. Even though the pattern of working in Civil Wing following CPWD formalities, the jurisdiction of the offices are not as in CPWD.  They are having on an average basis 10 to 14 Civil Division Offices and one Electrical Division for three Civil Divisions in each state, whereas in our Department there is only one Civil Division Office for each State. The jurisdiction of Electrical Division consists more than the jurisdiction of Superintending Engineer, Postal Civil Circle. The Junior Engineers jurisdiction in CPWD limits below 30 to 40 geographical square kilometer, whereas in our Department for more than 250 geographical square kilometer including hilly regions.  For example one Junior Engineer is attending the works of more than two states in North East Region where everybody will appreciate that most of the areas situated in hilly/snowfall areas.  The Junior Engineer who visits a site in North East Area takes two days for single inspection and before completing the work he had to travel at least four to five times during the course of execution of work by contractors. Hence the post of Junior Engineers should be increased to four in each Sub-Divisions to meet the requirement of proper supervision.

 The actual requirement of staff in Circle/Division/Sub-Division Offices are furnished in a flow chart form in next two pages :-
CIRCLE OFFICE
1.   ASSISTANT ADMINISTRATIVE OFFICER now Office Superintendent :-Considering the importance of this post, the CPWD has upgraded the post of Office Superintendent to Assistant Administrative Officer in gazetted rank vide their Order No.48(1)/4/09/S&D/363 dated 30.06.2012.  The duties of this posts clearly mentioned in the CPWD Manual.  It is therefore proposed that as the Office Superintendent working in the Civil Wings may be re-designated as Assistant Administrative Officers and assigned the duties stipulated in the CPWD Manual
2.   WORKS CLERK GRADE-I : The actual requirement of this cadre is 5 Nos. in Circle Office as detailed below
i)             1 For Assisting Executive Engineer (Planning & Development)
ii)            1 For Administrative matters of all Gazetted officers falling under the Circle.
iii)          1 For Administrative matters including cadre controlling like MACP, Promotion, Posting & Transfers, Seniority of Non-Gazetted staff falling under the Circle Office
iv)          1 for RTI, Preparation of Pay Bills etc. Submission of reports,
v)           1 for House Keeping , Court Cases, Arbitration Cases,   Enlistment of contractors
3.  WORKS CLERK GRADE-II
a)   1 For cashier of Circle Office
b)   1 For Assisting EE (P&D)

DIVISION OFFICE
I.             ASSISTANT SECTION OFFICER :  Presently as per the instructions of the Chief Engineer, Civil there is no supervisory posts in the Division Office but the Assistants then Head Clerk are compelled to attend the supervisory works of the administrative side of the Division Office.  The duties of the then Head Clerk is clearly mentioned in the CPWD Manual. Now the CPWD has re-designated the post of Head Clerk as Office Superintendent.  Since the Department of Personnel & Training in latest orders the posts of Assistants have been re-designated as Assistant Section Officers.  It is therefore proposed that as the Assistants working in the Civil Wings may be re-designated as Assistant Section Officers and assigned the duties stipulated in the CPWD Manual excluding duties of the assisting the Executive Engineer for Arbitration and Court Cases.
II.            Works Clerk Grade-I – 6 Nos. in total is required. 
1 Each for looking after the auditing and allied works of each Sub-Divisions under the Division Office   ACTUAL – 4 Nos.
1     for Establishment matters
1     for Preparation of Pay Bills and other dues to officers and staff 

III.       Works Clerk Grade-II – 4 Nos.
1     Cashier  and Enlistment of Contractors correspondences
1       Budget, RTI and submission of monthly reports
1       House keeping and General matters
1    Uploading tenders and Diary Dispatch.

2.Implementation of Cadre Review in Civil Wing non-gazetted staff :- In accordance with the accepted report of VIth CPC, the Cadre Review of all cadres was mandatory. But the Civil Wing has constituted a Committee headed by the Superintending Engineer (P&D) in the Civil Wing, Department of Posts, New Delhi for considering the cadre restructuring of the non-gazetted ministerial staff at fag end without any justification for delay on the basis of prevailing Government orders to consider the cadre reviews in all cadres.  The Union members were also attended as members of the Committee meetings and put forth proposals in this regard.  After a long deliberations the Committee finalized a report and submitted to the Chief Engineer (Civil) for consideration and implementation of the same in the March, 2015.  But due to best reason known to the administrative authorities the same has not yet been either approved or implemented.  The benefit of the cadre review is due since 01.01.2006 as per the recommendation of the Committee and in accordance with the VI Pay Commission. But in the last formal meeting held with the Chief Engineers by the Union Representatives it was informed that the file has been returned from the Directorate with some observations and when we enquired about the observations it was told that it is nothing to do with the Union but by the office.  When minutes of the meeting issued it is noted that the Union has to be furnish new proposals for Cadre Review.  When the matter was included in the Departmental Council also the same has been reiterated.  Actually, the office of Chief Engineer has informally told to one of the Union Representative that the details of the Cadre Review dealt in Directorate may be obtained if possible and the matter will be taken up accordingly.  The Cadre Review of the Civil Wing is highly over due to the staff members and the staff of Civil Wing may be brought at par with the other Departmental Staff.

3.Rule-38 transfers to Works Clerk Grade-II and Junior Engineers:-  Number of applications from the staff members are pending in the Chief Engineers office for Rule-38 transfers to the home state or nearby state as newly recruited staff by the Staff Selection Commission has allotted candidates to very far places from the home states.  The Chief Engineer has turned number of applications by mere reasons of non-declaration of probation period of the staff members.  The belated action of the Department for issuing the confirmation order by the Civil Circle Heads is not because of the reason in the control of the staff members.  Further, as per existing orders of the Government a person who has been appointed against the regular post and completes the probation period successfully are considered to be confirmed against the posts.  The matter may be reviewed and the orders for transfers wherever vacancy exists may be issued. 
4.Promotion of Works Clerk Grade-II and M.T.S:-  The Recruitment Rules provides for the promotion quota for both the Works Clerk Grade-I and Works Clerk Grade-II from the grade of W.C.Grade-II and MTS respectively.  But in most of the Civil Circle offices are not filling up the vacancies due to mere reasons.  The Civil Administration may be directed to take immediate necessary action to fill up all vacant posts of Works Clerk Grade-I and Grade-II

5.Recruitment of Draughtsman posts:-  The post of Draughtsman is a mandatory post in Civil and Electrical Divisions for assisting in technical nature of works to the Executive Engineer in finalization of estimates, drawings and bills.  But as on date ninety percent of these offices are not having any Draughtsman posts exists but that works are got it done through the clerical cadre officials which is highly against the procedures and code of utilization of financial powers of the Executive Engineers.  The Recruitment Rules for the post of Draughtsman has since been finalized and published by the Department very recently.  Action to fill up the vacancies on promotion from the eligible candidates can be done very easily and the process of direct recruitment should also be commenced.  The RR provides for promotion of MTS @ 0.5% only.  Hence the post will be covered in each circles hence it should taken as on All India Basis and the promotions to the eligible candidates in their circles should be considered.   

6.Up-gradation of Office Superintendent posts in Civil Circle as Assistant Administrative Officer:-  At present the posts of Office Superintendents in the Civil Circle are posted in the Non-Gazetted posts as is done is CPWD offices.  Now the CPWD has upgraded the post of Office Superintendents to Gazetted rank and amended the designation as Assistant Administrative Officer.  The action is warranted in Postal Department also.  At present the Engineering Officers are posted to assist the Superintending Engineers in the administrative matters who can be diverted to their engineering fields instead of administrative works.  The capability of disposing of the administrative matters will be higher than the engineering cadre officers as the office superintendents are promotional posts of the clerical cadre of the Civil Wing hence they are well versed with the administrative and nature of civil wing works.

7.Redesignation of post of Assistant to Assistant Section Officers:-  At present there is no supervisory posts in Division Offices are available as per the latest instructions of Civil wing Administration.  An official is getting promotion to the grade of Assistant in the civil wing is after more than twenty years of service and they should be assigned with the supervisory nature of works and their designation should be Assistant Section Officer as was done by the Department of Personnel and Training recently.

8.Exclusion of ministerial staff from outstation postings:-  As on date the ministerial staff in Group-C are liable to be transferred within the jurisdiction of Postal Civil Circles which is covering three to four states.  The transfers of the Group-C to other states disturb their living and establishment of family life in their respective home states.  Hence the liability of transfer should be restricted to Divisional Level.

9.Formation of JOINT COUNCIL IN CIVIL ESTABLISHMENT:-  The joint council is formed in every Postal Circles but there is no joint council machinery in the Civil Wing.  Due to non-availability of the joint council we do not have any platform to raise our issues before the administrative heads as the CPMGs are not entertaining any issues relating to Civil Wing stating that they are incompetent to direct the administrative offices of Civil Wing to sort out the issues in Civil Wing and hence lot of issues raised by the unions are not attended by the administration.  It is therefore requested that Civil Wing Administration may be directed to constitute the JCM machinery immediately so that most of our issues can be sorted out then and there.
