DATE OF EFFECT FROM 01-01-2016 AND RESTORATION OF RATE OF HRA DENIED.
Hold a Nation wide protest demonstration  in front of Divisional offices on 10/07/2017.
NDA Government has once again betrayed the entire Central Govt Employees. The demand of the employees to restore HRA to 30, 20 & 10% is denied. The date of effect for allowances is fixed at 01-07-2017 denying 18 months arrears.
The BJP lead NDA Government deliberately delayed the legitimate right of the employees. The assurance given by Cabinet Ministers regarding the increase in Minimum Pay and Fitment Formula  is also not honoured till date.
Federation of  National postal organizations  calls upon its members to hold demonstrations in front of all Divisional  Offices protesting against the anti-employees, anti-workers stand of the NDA Government.

WE WANTED BRING TO THE NOTICE OF ALL MEMBERS THAT SOME SENIOR OFFICERS IN OUR WING BEHAVES LIKE LORDS OF THE DEPARTMENT WITH GROUP-C TECHNICAL AND MINISTERIAL STAFF ON THE BASIS OF CASTE, CREED, REGION, RELIGION.  WE WOULD LIKE TO SAY THAT THE WORLD HAS REDUCED LOT AND MORE OR LESS IT IS IN ONE UMBRELLA AND THE DIFFERENCES SHOULD REDUCE ACCORDING TO THE PRESENT TIME.  BUT CERTAIN OFFICERS ARE EVEN ADVISING STAFF MEMBERS WHO HAVE COMPLETED SUCCESSFUL AND COMENDABLE REMARKS FROM PREVIOUS OFFICERS TO SEEK VOLUNTARY RETIREMENT, FIXING UP OF RESPONSIBILITIES, SEXUAL HARASSMENT AND WITH SADIST MENTALITIES.  THIS IS NOW RAISING BECAUSE OF THE REASON THAT TILL NOW UNION WAS BEHAVING GENTLY AND POLITELY WITH DEPARTMENT. BUT WE COULD NOT ACHIEVE ANY BENEFITS FOR WHICH WE ARE ELIGIBLE LIKE CADRE REVIEW AND LOT OF ISSUES. THE DEPARTMENTAL OFFICERS WERE THINKING THAT WE ALWAYS MOVE WITH BEGGING BOWL FOR OUR RIGHTS EXTENDED BY THE GOVERNMENTS.  WE WERE BRINGING TO THE HIGHEST OFFICERS IN CIVIL WING ABOUT THE HARASSMENT FROM CERTAIN OFFICERS NOT EVEN LEAVING DISABLED PERSONS.  SOME QUARTERS WERE ISSUING MORE THAN 250 MEMOS IN AN YEAR TO NEWLY ENTRANTS AND NO MERCY IS SHOWN TO DISABLED AND FEMALE EMPOYEES RESTRICTIONS ACCORDING TO THEIR HEALTH CONDITIONS VARIES BEFORE AND AFTER MARRIAGE AND CONFIDENTIALITY OF THEIR HEALTH CONDITION.  ONE OFFICER HAS SERVED MEMO TO A FEMALE OFFICIAL ON THE MARRIAGE DATE AS GIFT OF DEPARTMENT.  EVEN AFTER BRINGING TO THE NOTICE ON INFORMAL BASIS BY THE UNION TO AVOID DEPARTMENTAL ACTIONS ABOUT THE DIFFERENT ATTITUDES ON THE BASIS OF CASTE, CREED, RELIGION, LINGUISTIC ETC. NO CHANGE HAVE BEEN FELT BY US.  WE SHOULD UNDERSTAND THAT WE ARE WHISTLE BLOWERS FOR THE CIVIL WING BECAUSE OF THE REASON THAT EXECUTION PROGRESS IN WORK AND PAYMENT TO THE CONTRACTORS ARE IN THE HANDS OF GROUP-C STAFF (MEANT JUNIOR ENGINEERS AND MINISTERIAL STAFF) AND WE ARE THE REAL CLAIMANT OF THE FEATHERS ON CAP IN CIVIL WING OFFICES.  NOW SOME OFFICERS ARE ACTING LIKE DICTATORS. THE PAYMENT OF CONTRACTORS ARE PAID IN LIGHTENING SPEED BUT THE DUES PROVIDED BY THE GOVERNMENT TO US GETS HINDERED ON THE BASIS OF ONE OR OTHER REASON BEST KNOWN TO EVERYBODY. EVEN FOR AVAILING A CASUAL LEAVE BY A STAFF MEMBER WITHOUT CONSIDERING THE DISABILITY, FEMALE RESTRICTIONS ETC. THEY HAVE TO ROAM BEHIND THEM WITH BEGGING BOWL. WE THINK ONE OF THE PRIOR OCASSION ALSO WE HAVE MENTIONED THAT A CASE OF A DISABLED PERSON IS LYING IN THE OFFICE OF CHIEF ENGINEER FOR MORE THAN ONE YEAR FOR ONE LINE APPROVAL.  NOW WE CANNOT BE SILENT SPECTATOR FOR ALL THESE THINGS.  WE WILL RAISE THE ISSUE IN WRITING WITH SUPPORTING DOCUMENTS TO THE CONCERNED DIVISIONS AND AGENCIES AGAINST THE OFFICERS WHO MAINTAINS THE SADIST MENTALITY AND MAKE HARASSMENTS TO LOWER STAFF.

2.        WITHDRAW ALL TRANSFER AND POSTING ORDERS ISSUED AFTER 28.03.2017 AND BRING THE STATUS QUO ON THAT DATE TILL THE POLICY IS ISSUED RESTRICTING TO THE REDISTRIBUTION OF STAFF CASES THAT TOO IN ACCORDANCE WITH THE DIRECTIVES OF GOVERNMENT/DEPARTMENT FROM TIME TO TIME IN THIS REGARD
3.        REPATRIATION OF ALL OPERATIVE STAFF ON WORKING ARRANGEMENT BASIS FROM POSTAL CIVIL WING
      IF IT IS NOT ACCEDED TO BY THE DEPARTMENT WE WILL BE COMPELLED TO FILE THE CONTEMPT OF COURT CASE AS WELL AS WE WILL REVIEW THE AGITATION PROGRAMME OF HUNGER STRIKE BY GENERAL SECRETARY IN FRONT OF DAK BHAWAN AFTER GIVING PROPER NOTICE BY JULY FIRST HALF AND STALL THE FUNCTIONING OF THE OFFICES BY PEN DOWN OR WORK TO RULE BY OUR RANK AND FILE BY AN AMICABLE SETTLEMENT IS ARRIVED AT THE ABOVE ISSUE AND ALSO IN PROTEST OUR UNION WILL NOT ATTEND ANY MEETING CONDUCTED BY CHIEF ENGINEER (CIVIL).

OFFICE MEMORANDUM

Subject: Recommendations of the 7th Central pay Commission - Bunching of stages in the revised pay structure under Central Civil Services (Revised Pay) Rules, 2016.

With reference to the subject mentioned above and in continuation of this Department’s OM of even number dated 07.09.2016, the undersigned is directed to inform that, a large number of references have been received from Ministries/Departments seeking clarifications relating to the application of the benefit on account of bunching of stages while fixing the pay in the revised pay structure.

2. It has also been brought to the notice of this Department that some offices have extended the benefits on account of bunching based on subjective interpretation of the provisions of OM dated 07.09.2016, which may not be consistent with the principles and philosophy of the 7th CPC recommendations on bunching. Implementation of such pay fixation orders are not in conformity with the 7th CPC principles on bunching and may create further anomalies. In order to ensure consistency of approach in applying the provisions relating to bunching and to address the queries on various aspects of bunching, it has been decided to issue detailed guidelines on bunching.

3. All Ministries/Departments are , therefore. advised that the implementation of the provisions on bunching in OM dated 07.09.2016 may be put on hold till the time the detailed instructions in this regard are issued by Department of Expenditure. It is also requested that if orders on account of bunching have already been issued by Ministries/Departments but not implemented, the same may not be given effect to.

THE CASE FILED BY US BEFORE THE HON'BLE CAT CAME UP FOR HEARING ON 12.06.2017.  THE DEPARTMENT HAVE NOT PRODUCED THE TRANSFER AND POSTING POLICY STATED BE AVAILABLE IN THE DEPARTMENT.  OUR COUNSEL HAVE PRODUCED ALL DOCUMENTS BEFORE THE COURT AND ARGUED THAT THERE IS NO EXISTING POLICY.  AT ANY POINT OF TIME THE COURT HAVE NOT WITHDRAWN THE VERBAL INSTRUCTIONS PASSED ON 29.05.2017AND 06.06.2017 REGARDING THE TRNSFER ORDERS HENCE WE FEEL THAT THE ORDERS PASSED STILL HOLDS GOOD.  WE REQUEST ALL MEMBERS THAT IF ANY ORDERS IS ISSUED BY THE DEPARTMENT THEY MAY INDIVIDUALLY FILE CASES IN RESPECTIVE BENCHES OF THE COURTS CHALLENGING THE ORDERS OF TRANSFER.  THE CHQ WILL PROVIDE ALL DOCUMENTS AVAILABLE WITH US FOR SUPPORTING DOCUMENTS.

FROM SOME QUARTERS A QUESTION HAVE ARISED THAT WHY OUR UNION IS NOT ATTENDING THE MEETING TO BE HELD ON 19.06.2017 CONVENED BY CHIEF ENGINEER WHEN OUR COUNTERPART UNION HAVE CONSENTED FOR IT.  WE FEEL AN EXPLANATION FROM GENERAL SECRETARY IS REQUIRED HENCE THIS POST. AS FAR AS NON GAZETTED EMPLOYEES OF CIVIL WING CONCERNED THE MAJOR ISSUES ARE CADRE REVIEW, CREATION OF POSTS AND TRANSFER AND POSTING POLICY APART FROM SOME MINOR ISSUES WHICH WE HAVE PROJECTED IN OUR STRIKE NOTICE CHARTER OF DEMANDS.  ALL THE ELEVEN ISSUES WERE DISCUSSED AT THE SECRETARY LEVEL ON 28.03.2017 AND MINUTES WERE ISSUED BY THE DEPARTMENT EVEN THOUGH IT WAS NOT REFLECTING THE FACTUAL DISCUSSION FOR WHICH WE HAVE REPRESENTED TO SECRETARY.  NOW ALL THESE MAJOR ISSUES ARE LYING IN THE OFFICE OF CHIEF ENGINEER SINCE THEN.  ONCE A SENIOR LEVEL MEETING HAS BEEN CONDUCTED AND MINUTES ISSUED WITH THE COMMENTS THAT ACTION BY SO AND SO, WE HAVE TO WAIT FOR QUITE SOME TIME FOR THE ACTION TAKEN BY THE RESPECTIVE OFFICES.  NOW EVERYBODY KNOWS THAT TWO MONTHS ONLY PASSED AND IT IS NOT POSSIBLE FOR ANY DEPARTMENTAL OFFICER CAN FINALISE THE MAJOR ISSUES LIKE CADRE REVIEW, CREATION OF POST ETC.  TILL NOW AS PRESIDENT/GENERAL SECRETARY I HAVE ATTENDED VARIOUS MEETING FOR LAST SIX YEARS EVEN ALONE EXCEPT IN SOME OCCASIONS RAISED VARIOUS ISSUES BEFORE THE CHIEF ENGINEERS. BUT ALL WERE GONE IN VAIN BECAUSE NO FOLLOW UP ACTION CAME OUT THAT MEANS WASTING OF TIME, ENERGY, MANPOWER FOR PREPARING AGENDA ITEMS AND COLLECTING DATAS FOR DISCUSSION ETC.  AS EVERYBODY KNOWS THAT WHENEVER WE RAISE AN ISSUE RELATING TO STAFF MEMBERS THE CHIEF ENGINEERS WERE SHIFTING THE RESPONSIBILITIES TO  CIRCLE LEVELS WHERE NEITHER MEETINGS WERE CALLED FOR SETTLING ISSUE NOR COMPLYING THE DECISIONS OF THE MEETING WITH CHIEF ENGINEER HAVE TAKEN PLACE EXCEPT IN THE CASE OF PRESENT TRANSFER ISSUE.  WE HAVE ALREADY FILED THE PETITION BEFORE THE HON’BLE CAT, ERNAKULAM AND NEXT HEARING IS ON 12.06.2017 FOR ISSUANCE OF THE UNIFORM TRANSFER AND POSTING POLICY BY THE DIRECTORATE INCORPORATING THE DEPT. OF PERSONNEL AND TRAINING DIRECTIVES.  NOW EVERYBODY CAN SEE THAT WE ARE FIGHTING FOR THE CAUSE OF ALL NOT FOR THE INDIVIDUAL BENEFIT OF ANY OFFICE BEARER LIKEWISE OF OUR COUNTER PART UNION. 
NOW THEY HAVE PROJECTED THE AGENDA FOR POSTING OF ASSISTANT IN BANGALORE AND BOMBAY.  AS FAR AS BANGALORE CIRCLE IS CONCERNED THERE IS NO VACANCY OF ASSISTANT AS ON DATE AND IT MAY ARISE ONLY AFTER 30TH JUNE WHEN PROMOTION ORDER OF ASSISTANT TO OFFICE SUPERINTENDENT IS ISSUED AND JOINS WITHIN ONE MONTH.  DISCUSSION ON THE CADRE REVIEW WITH CHIEF ENGINEER AT PRESENT IS ONLY AN EYEWASH AND CONDUCTING THE MEETING ON 19.06.2017 ITSELF IS ALSO A PLEASING TO ATTITUDE OF OUR DEPARTMENTAL OFFICERS WITHOUT ASKING OUR CONVENIENCE ITSELF TO COMBINE THE COUNTERPART UNIONS CIRCLE CONFERENCE AT DELHI. IN VIEW OF THE ABOVE I AS A GENERAL SECRETARY IS NOT CHANGING OUR STAND THAT TILL MEETINGS WITH CIRCLE SUPERINTENDING ENGINEERS ARE CONDUCTED AS PER MANDATORY TRADE UNION FACILITY WE WILL NOT ATTEND THE MEETING CALLED FOR BY THE CHIEF ENGINEER AS NO POSITIVE RESULT WILL COME OUT FROM IT. INCIDENTALLY I POINT OUT ONLY ONE INCIDENT.  THE DECISION AT THE ADDITIONAL DIRECTOR GENERAL(CO-ORDINATION) ON 28.03.2017 THAT NO TRANSFER AND POSTING WILL BE ISSUED TILL 31.05.2017 ON THE BASIS OF THE ORDERS OF CHIEF ENGINEER ISSUED ON 02.02.2017 AND 06.02.2017.  BUT ON 13.04.2017 THE AHMEDABAD CIRCLE HAVE ISSUED TRANSFER ORDERS ON 13.04.2017 AND PUT INTO EFFECT IMMEDIATELY.  FURTHER THE TRANSFER ORDERS IS NOT ON THE BASIS OF THE RECOMMENDATION OF THE COMMITTEE FOR THE PURPOSE BUT ON THE WHIMS AND FANCY OF SUPERINTENDING ENGINEER. FURTHER WE REQUESTED THE CHIEF ENGINEER REGARDING ONE OF OUR MEMBER WHO IS A DISBALED MAN WHOSE CASES IS PENDING IN HIS OFFICE PENDING FOR MORE THAN TEN MONTHS AND THE HARASSMENT BEING FACED BY HIM WAS EXPLAINED AND EVEN VIDEO OF HIS CONDITION WAS SHOWN TO CHIEF ENGINEER BUT NO ACTION HAVE BEEN TAKEN IN THIS REGARD AND STILL THE HARASSMENT PERSISTS. FROM THIS IT IS VERY CLEAR THAT DEPARTMENT IS NOT KIND ENOUGH TO LOWER GRADE OFFICIALS AND SHOULD BE TREATED AS THEIR SLAVES AND MAID SERVANTS. THEN WHAT PURPOSE WILL BE SERVED IF WE ATTEND THE MEETING ON 19.06.2017.  SINCE NOW WE AGITATE DEFINITELY I EXPECT HARASSMENT TO ME AND NEGATIVE DECISIONS IN PERSONAL ISSUES BY IMMEDIATE SUPERIOR OFFICERS AND EVEN THEY WILL TRY TO KEEP ME AT A DISTANT PLACE FROM MY FAMILY ETC. EVEN IF I AM ELIGIBLE FOR IT IN ONE OR OTHER WAY.  I HOPE THAT ALL MEMBERS WILL SUPPORT ME WHEN ANY ADVERSE THING HAPPENS TO ME ON THIS ACCOUNT. AS GENERAL SECRETARY I CAN ASSURE YOU THAT I WILL NEVER BEND BEFORE THE DEPARTMENT FOR MY PERSONAL GAIN.  WE HAVE FOR QUITE LONG YEARS BOWED BEFORE THE DEPARTMENTAL OFFICERS UPTO DEEP END OF THE BOREWELL IN DESERTS BUT THE ADMINISTRATION WAS DANCING ON OUR HEAD TO DIG FURTHER. IF WE UNITEDLY AGITATE AS PER TEMPO NOW THE ULTIMATE WIN WILL BE WITH US. 
 
NOW WE MAY UNITEDLY DECIDE WE WILL NOT COMPROMISE WITH DEPARTMENT

We have filed an RTI application to the Superintending Engineer, PCC, Ahmedabad for which they have directed to deposit the cost of the documents to be supplied which we have complied.  Now we got a letter along with enclosures from the office of the Superintending Engineer, PCC, Ahmedabad duly signed by the EA to SE in a form routine official communication copy of which is enclosed herewith for your ready reference which is against the letter and spirit of the RTI Act, 2005 and guidelines issued by the nodal ministries.  The application should have been dealt by a notified officer as Public Information Officer in that office.  The letter directed me if there is any appeal it should be submitted to the Superintending Engineer, PCC, Ahmedabad himself which is highly irregular.  
          On perusal of the documents it is clearly evident that the documents are recreation on back date dispatch numbers for which we will be separately filing complaint before the competent authorities for enquiry including the RTI Commission for non-compliance of instructions issued in the matter from time to time including the Hon’ble RTI Commission.
          Further it is stated that on receipt of the RTI application from me, the officers have started to initiate humiliating attitude towards our members by issuing memos etc. Since, the RTI application is filed by me the reasons for official harassment against our members is unwarranted and we presume that it is because of the directions from some quarters at higher level.

                   It is for your information and necessary action.

          We would like to state that in certain Postal Circles the reimbursement of mobile phone bill to Junior Engineers and brief case to Assistants (as they are normally attending the court cases and arbitration cases in addition to their own duties) are permitted.  As there is no uniform instructions have not been issued to the field offices regarding the subjects mentioned above there is discrimination within the cadre.  It is, therefore, requested that necessary orders may please be issued in this regard so that everybody in the cadres mentioned above get the benefit uniformally.

MEDICAL REIMBURSEMENT TO PENSIONERS ORDERS

OFFICE MEMORANDUM

Sub:- Reimbursement of medical claims to pensioners under CS (MA) Rules, 1944 as directed by various CATS/Courts – Regarding.

The undersigned is directed to state that various references are being received in Ministry of Health and Family Welfare on the above mentioned subject. it is hereby clarified that CS (MA) Rules, 1944 are not applicable to pensioners till date.

2. It is further informed that the following options to avail medical facilities are available to Central Government pensioners:

a) Pensioners residing in CGHS covered areas:

1) They can get themselves registered in CGHS dispensary after making requisite contribution and can avail both OPD and IPD facilities.

2). Pensioners residing in CGHS areas cannot optout cf CGHS and avail anyother medical facility {i.e. Fixed Medical Allowance). Such pensioners, if they do not choose to avail CGHS facility by depositing the required contributions, cannot be granted Fixed Medical allowance in lieu of CGHS.

b) Pensioners residing in non -CGHS areas:

1). They can avail Fixed Medical Allowance (FMA) @ Rs.500/- per month

2) They can also avail benefits of CGHS- [OPD and IPD] by registering themselves in the nearest CGHS “city after“ making the required subscription.

3) They also have the option to avail FMA, for OPD treatment and CG HS for IPD treatments after making the required subscriptions as per CGHS guidelines.

3.In view, of the above, reimbursement of medical claims to pensioners under CS (MA) Rules, 1944 as directed by various CATS/Courts, need not be referred to the Ministry of Health and Family Welfare. The respective Administrative Department/Ministry may take their own decision in this regard.

4. Further, all Departments/Ministries are requested to intimate their employees proceeding for retirement regarding the above options for medical facilities available to the Central Government pensioners.

5.This issues with the approval of competent authority.
